These Terms of Service ("Terms") govern your use of the Instead mobile application ("Instead", "the app", "we", "our", or "us"). By creating an account or using the app, you agree to these Terms.
Instead is a habit-tracking application that helps users replace unwanted habits with healthier alternatives. The app provides tools to log swaps, track savings, monitor health metrics, and participate in a community of users with similar goals.
You must be at least 13 years old to use Instead. By using the app, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

We reserve the right to suspend or terminate accounts that violate these rules.
You retain ownership of content you create (posts, comments, etc.). By posting content in public areas of the app, you grant us a non-exclusive, royalty-free license to display that content within the app. You may delete your content at any time.
Instead is not a medical application. The app is designed to support habit change and is not a substitute for professional medical advice, diagnosis, or treatment. If you are experiencing severe withdrawal symptoms, addiction, or mental health concerns, please contact a healthcare provider. Never disregard professional medical advice because of information provided by the app.
Savings calculations and financial data displayed in the app are estimates based on information you provide and transaction data from connected bank accounts. These figures are for informational purposes only and do not constitute financial advice. We are not a financial institution and do not provide financial services.
Instead integrates with third-party services including Plaid (bank connections), Apple HealthKit (health data), and RevenueCat (subscriptions). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability or accuracy of third-party services.
Instead offers optional paid subscriptions managed through the Apple App Store. Subscription terms, pricing, billing, and cancellation are governed by Apple's terms. You can manage or cancel your subscription at any time through your device's subscription settings.
We strive to keep Instead available and functional, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. We will make reasonable efforts to notify users of significant changes.
To the maximum extent permitted by law, Instead and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Instead and its operators from any claims, damages, or expenses arising from your use of the app or violation of these Terms.
You may stop using Instead at any time by deleting your account. We may terminate or suspend your account if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state in which the operator resides.
We may update these Terms from time to time. If we make material changes, we will notify you via the app or email. Continued use of the app after changes constitutes acceptance of the updated Terms.
